The background
In March 2020, the UK Government began to implement measures to combat the transmission of COVID-19. As a result, many businesses were forced to close or to significantly adjust their operations.
Some businesses made business interruption Covid claims under their general business, or property, or commercial landlord insurance policies. Initially many insurers refused to pay, arguing that their policies were not designed to cover business interruption insurance during a pandemic.
Ultimately, the Financial Conduct Authority (FCA) intervened, leading to a case being brought in the High Court.
The High Court ordered many insurers to pay Covid business interruption insurance claims, and some did. However, despite this ruling, a number of issues remained unclear, and some insurers continued to deny claims.
Further court cases
Since the High Court case, several further court cases have been brought, in order to try to clarify the points which remained unresolved in relation to business interruption claims due to COVID-19.
A number of recent decisions have found in favour of businesses, significantly increasing the number of organisations that may now (unknowingly) have a valid business interruption Covid-19 claim under their insurance policy, even where such claims have previously been denied or rejected by the insurer or the broker.
Data published by the FCA suggests that there may still be hundreds of thousands of businesses in the UK that have yet to make valid Covid business interruption insurance claims against their insurers, with an average claim value of around £40,000.
